Two funeral plan firms set to be banned from trading next month are still advertising to new customers.

From July 29, all providers must be authorised by the Financial Conduct Authority. After this date businesses will face legal action if they continue to offer funeral plans or deliver those already sold.

Empathy Funeral Plans UK, which has 7,000 customers, withdrew its application for authorisation in April, and Unique Funeral Plans failed to apply at all.

Yet both are still promoting plans that cost thousands of pounds on their websites. Unique’s site also claims funds are held in a trust managed by Sterling Trust Corporation. 

But the firm says this is not true and has asked for the statement to be removed.

The City watchdog is urging customers not to pay for plans that are unlikely to ever be delivered.

An Empathy spokesman says it has stopped selling new plans and is in ‘active discussions’ with larger providers regarding existing customers.
