WASHINGTON—Antitrust enforcers at the Federal Trade Commission have appealed an administrative-law judge’s decision to dismiss a lawsuit challenging Illumina Inc.’s $7.1 billion acquisition of cancer-test developer Grail Inc.
The move means the case will now be considered by the five-member commission, which is composed of three Democratic members and two Republicans. FTC Chairwoman Lina Khan, who leads the commission and has taken a stricter view of antitrust violations, would participate in the review.
